Is it copyright infringement to use audio from a YouTube video to make app?

Question by The Jakester: Is it copyright infringement to use audio from a YouTube video to make app?
I’m simply wondering if it is okay to use audio from a YouTube video to make an app for the Android Market. It seems like it would be copyright infringement, but consider the numerous “Bed intruder sound boards”. And I don’t know if this matters but it would be a free app. Also, if i were to put an ad in it would it change whether it is copyright infringement or not? If someone could shine some light on this for me that’d be great. Thanks

You can’t use someone else’s audio without permission. Just because it’s on YouTube does not mean it’s free for you to use. It also makes no difference that you would distribute the app freely. The presence of an ad also makes no difference.
