Question by Snowflake: How to sell this on Ebay without copyright infringement?
I enjoy a popular series of vampire themed novels (not Twilight). I have created handmade jewelry that goes along with the book’s theme and would like to sell the pieces on Ebay. The pieces are original, not copied designs from any other person. I created them because I wanted to buy something like this and figure other fans would too. How do I list them safely, without risk of copyright or other similar infringement laws being broken? Thanks for any advice.

Don’t mention anything about the show just say vampire jewellery

    You have to get permission from whoever holds the copyright. There’s no other way to do it, legally. Write to whoever holds the copyright on the book and ask for permission. Some people will want a commission on each piece sold, some will want an article (piece of jewelry, in this case) and a lower commission. Once you get permission, you can say, in your listing, that you have it.

    Many writers have avid fans…and the fans will communicate with the writers, if they see something based on a book or series. So make sure that you get permission to sell anything that you’ve based on someone else’s creativity.

    If the jewelry is based upon any drawing in the books, then the author/artist/publisher of the book owns the copyright on those designs and any “derivative works.” If you have created jewelry from a written description of something, then YOU are the creative force that created the new sculpture, as the “idea” for a character is not protected by copyright.
